Store regulations
§ 1 — Preliminary Provisions
- The online store Mac Jons, available at macjonsafricanshop.pl, is operated by Joan Tambe Njok Tabe conducting business under the name “Mac Jons” Joan Tambe Njok Tabe, NIP 5252628232, ul. Bakalarska 11/2A 11, 02-212 Warsaw, Poland.
- These Terms & Conditions are addressed to Consumers and govern the rules and procedures for concluding Distance Sale Agreements through the Store.
§ 2 — Definitions
- Consumer — a natural person entering into an agreement with the Seller through the Store, where the subject matter is not directly related to their business or professional activity.
- Seller — “Mac Jons” Joan Tambe Njok Tabe, NIP 5252628232, ul. Bakalarska 11/2A 11, 02-212 Warsaw, Poland.
- Customer — any entity making purchases through the Store.
- Entrepreneur — a natural person, legal person, or organisational unit without legal personality, conducting business activity in their own name and using the Store.
- Store — the online store operated by the Seller at macjonsafricanshop.pl.
- Distance Agreement — an agreement concluded with the Customer within an organised distance-contracting system, without the simultaneous physical presence of the parties, using exclusively means of distance communication.
- Terms & Conditions — this document.
- Order — the Customer’s declaration of intent submitted via the Order Form, aimed at concluding a Sale Agreement for one or more Products with the Seller.
- Account — the customer account in the Store, storing the Customer’s data and order history.
- Registration Form — a form available in the Store enabling the creation of an Account.
- Order Form — an interactive form enabling an Order to be placed, including adding Products to the Cart and specifying delivery and payment terms.
- Cart — a Store feature displaying selected Products, with the ability to adjust quantities and Order details.
- Product — a movable item or service available in the Store that is the subject of a Sale Agreement.
- Sale Agreement — a sale agreement concluded between the Customer and the Seller via the Store, including, where applicable, service agreements and contracts for work.

§ 4 — Technical Requirements
To use the Store, including browsing products and placing orders, the following are required:
- A device with internet access and a modern web browser (Google Chrome, Mozilla Firefox, Opera, Safari, etc.)
- An active email address
- Cookies enabled in the browser
§ 5 — General Information
- To the fullest extent permitted by law, the Seller is not liable for disruptions or interruptions to the Store caused by force majeure, unauthorised third-party actions, or incompatibility between the Store and the Customer’s technical setup.
- Browsing the Store does not require an Account. Orders may be placed after creating an Account (see § 6) or by providing the necessary details without registration.
- All prices are quoted in Polish Złoty (PLN) and are gross prices inclusive of VAT.
§ 6 — Creating an Account
- To create an Account, complete the Registration Form providing: first name, last name, address, email address, and contact phone number.
- Account registration is free of charge.
- To log in, use the login and password set during registration.
- The Customer may delete their Account at any time, without giving a reason and free of charge, by contacting the Seller via the details in § 3.
§ 7 — Placing an Order
To place an Order:
- Log in to the Store (optional).
- Select a Product and click “Add to Cart”.
- Log in or proceed as a guest.
- Complete the Order Form with delivery details and select a shipping method.
- Click “Order and Pay” and confirm via the link sent to your email.
- Select a payment method and complete payment within the specified timeframe (see § 8).
§ 8 — Delivery & Payment
- Delivery options: in-store pickup at ul. Bakalarska 11/2A 11, 02-212 Warsaw.
- Payment methods: cash on pickup, cash on delivery, electronic payments.
- Full details on delivery and payment options are available on the Store’s website.
§ 9 — Fulfilment of the Sale Agreement
- A Sale Agreement is concluded upon the Customer placing an Order in accordance with § 7.
- The Seller will confirm receipt and acceptance of the Order by email. The Agreement is concluded at the moment the Customer receives this confirmation.
- For bank transfer or electronic/card payment: the Customer must pay within 7 calendar days of concluding the Agreement, otherwise the Order will be cancelled.
- For cash on delivery: payment is due upon receipt of the parcel.
- For in-store pickup: payment is due at the time of collection.
- The Product will be dispatched within the timeframe stated in its description.
- Where an Order contains Products with different delivery times, the longest stated time applies, unless the Customer requests partial deliveries.
- Delivery is available within Poland only.
§ 10 — Right of Withdrawal
- The Consumer may withdraw from the Sale Agreement within 14 days without giving any reason.
- The 14-day period begins from the date the Product is delivered to the Consumer or a designated third party (other than the carrier).
- For orders with multiple Products delivered separately, the period begins from delivery of the last item.
- For subscriptions, the period begins from receipt of the first item.
- To withdraw, the Consumer must submit a statement to the Seller before the deadline expires. The statement may be sent by post or electronically to the Seller’s email or via the Store’s website.
- A model withdrawal form is provided as an appendix to the Polish Consumer Rights Act of 30 May 2014; its use is not mandatory.
§ 11 — Complaints & Warranty
- The Sale Agreement covers new Products only.
- Complaints must be submitted in writing or electronically to the Seller’s contact details (see § 3) or via the complaint form on the Store’s website.
- It is recommended that complaints include: a description of the defect, the date it was noticed, the Customer’s contact details, and the requested remedy.
- The Seller will respond within 14 days. Failure to respond within this period is deemed acceptance of the complaint.
§ 12 — Personal Data
- The Controller of personal data collected through the Store is the Seller — “Mac Jons” Joan Tambe Njok Tabe.
- Personal data is collected for the purpose of fulfilling Sale Agreements and, with the Customer’s consent, for marketing purposes.
- Data may be shared with carriers fulfilling deliveries and payment service providers.
- Customers have the right to access and correct their personal data.
- Providing personal data is voluntary; however, failure to provide data necessary for a Sale Agreement will prevent it from being concluded.
§ 13 — Final Provisions
- Agreements concluded through the Store are made in Polish.
- The Seller reserves the right to amend these Terms & Conditions for valid reasons (e.g. changes in law or payment/delivery methods), with at least 7 days’ advance notice to Customers.
- Matters not covered by these Terms & Conditions are governed by applicable Polish law, in particular the Civil Code, the Act on Electronic Services, the Consumer Rights Act, and data protection legislation.
